The Supreme Court has announced that a speech and language disability over 40% shall not be a reason to reject admission to the medical college. The Supreme Court has decided that to maintain extensivity, the current rule prohibiting students with disabilities above the threshold needs to be re-examined and given a more liberal interpretation. According to TOI “This order was an answer to the plea of a student who has been denied admission to an MBBS program because of 44-45% disability.
A person's right to be considered for admission is not lost by a disability of 44–45%, according to the Bench of Justices BR Gavai and KV Viswanathan. The bench further emphasizes that the National Medical Commission's (NMC) strategy should not be used to deny students entrance to medical programs. The Court stated that differently-abled students' faith and trust in normal society would be damaged if the law were to be applied selectively.
The court said that the candidate with a 45% disability should not be a reason to deny admission and each candidate should be evaluated individually. Honourable court also expressed that the National Medical Commission (NMC) is expected to adopt a more comprehensive approach by providing reasonable lodgings for students with disabilities.
