In a historic ruling, the Supreme Court has upheld that Indian students who want to study medicine abroad must qualify for the NEET UG test first. The ruling supports the NEET requirement set by the Medical Council of India (MCI) in 2018, which is to ensure that students who want to pursue an MBBS degree abroad are qualified enough to practice medicine in India.
The Apex Court rejected petitions questioning this mandate, stating that the regulation is reasonable, transparent, and per statutory provisions. The bench, which included Justices B R Gavai and K Vinod Chandran, pointed out that the MCI has the powers under Section 33 of the Indian Medical Council Act, 1956, to make such regulations.
This move emphasizes the importance of maintaining the same eligibility criteria for MBBS admission, regardless of whether the education is pursued locally or internationally. Students who wish to practice medicine in India after obtaining their MBBS degree abroad must pass the NEET-UG exam before seeking admission to foreign medical colleges.
The Supreme Court judgment is intended to maintain the standards and quality of medical education so that all practicing doctors in India have the necessary knowledge and skills, irrespective of where they were trained.
