The Madras High Court has held the National Investigation Agency's (NIA) decision to freeze the tuition fee of a medical student of a private college, which has alleged links between the funds and a Maoist organization operating from Jharkhand. The student has challenged the NIA’s order by arguing that her education was disrupted as the college withheld her certificates due to the reason for the frozen fee.
During the hearing on Monday, representatives for the medical student argued that the private medical college’s administration was withholding her certification due to the frozen funds.
The court has dismissed the petition by advising the student to directly approach the NIA to unfreeze the amount which was supported by a satisfactory explanation. The bench has emphasized that the judiciary could not interfere in matters covering national security unless there was substantial evidence of misuse of authority. The judges also questioned potential risks of extremist influences on students receiving such financial support
The bench for this case has questioned the assurance that a well-performing student would not join an extremist group by highlighting the complexity and sensitivity surrounding the case.
